Trespassers - I don't like 'em! - Monday, March 31, 2008 5:05 PM ( #1 )
Just this past week I was out with my friend Frank on his property doing some spring scouting for tree stand locations and I ran across a trespasser's tree stand -- picture of tree stand below.  We were both enraged by the brazen and lawless behavior of the person responsible for constructing this stand on private property that is clearly marked as such. 

We called the local game warden and reported the crime and he is going to be sitting in the woods come opening day of the bow season in an attempt to apprehend this criminal.  Hopefully, this person will get caught and will have to pay all of the fines and spend some time in jail.

Sorry, just had to vent a little.

That stand is huge and whoever put it up doesn't even appear to have attempted to conceal it!    I also can't believe that anyone would be so brazen to put something like that up on private property that they have no right to be on.   Even worse is that they have the guts to leave it up all year.   I hope whoever did that is caught and pays the full price for the violation, including confiscation of the stand.   They should also have to pay the fair market price for the tree the stand is in because of the screwin steps they are using to access it!  I think if I were you I would put the biggest chain and lock on it that I could find and then remove the lower four or five steps.   Next, I would hide a game camera closeby  and I'll bet that eventually you will have a nice picture of the culprit.  They may be back before the opener to check things out and bingo, you have made it that much easier for the game warden to do his thing!!!

I would say it took two people to get that up, or more!
 
I used to have the same problem here, but seems to have died down a bit.  A lot of gun fire at my 50 and 100 yard range may have stopped some of it as well as my armed patrols throughout the farm.
 
The standard answer is "I used to hunt here" and my answer is when is the last time you paid taxes on this place and paid to put in food plots etc.  Also carry a .357 and a Mini 14 when out and about.
 
The last few years I have had zero that I know of.  But I blocked most of the trails into the place and that helps with the atv thing anyway.

By our calculations, the stand was at least 80 to 100 yards onto private ground.  Also, the fence posts that delineate Frank's property lines are clearly visible to anyone venturing close to this area. 
 
Believe it or not, there was an incident a season or two ago when Frank was out bowhunting by himself and actually got shot at 3 times with a high-powered rifle from the same general area.  Frank believes that the shots were only a scare tactic on the shooter's part as the shots "only followed him" as he ran off in another direction.  This incident happened before I knew Frank.  Had I been out with him on that particular day, I can guarantee you in no uncertain terms that the individual responsible would have been apprehended and punished!
 
After hearing about the shooting incident I was ready for blood, but Frank calmed me down a little.  As for now we're just playing it real cool and waiting for law enforcement to step in.

The warden said he would be in violation of several laws, including: trespassing, destruction of property (stand tree), and hopefully/probably more including: hunting with a rifle during the bow season, hunting without a license/tag, hunting over bait, etc.
 
I'll let you all know how it turns out and what we did to legally (although I have an idea for my own form of justice, albeit illegal, yet somehow in this case justifiable justice) stop this individual, so that it may help some of you out there deal with trespassers in the future.

as a NON-land owner, i would just like to assure you that i understand and support your point of view about trespassers.  since i am fairly new in my area, i find that i have very little private land that i can hunt on, though i do have a couple of ranchers that allow us to hunt on their property.  most of my hunting is done in a national forest that is used as range land during the summer so it is sectioned off with barbed wire fence for that purpose.  there are also several private tracts in the same area.  when i come to a fence in the woods, i treat it as a line fence.  i stay on the side that i know is forest property until i'm sure the other land is forest service also.  i have just one thing to say to people who are in my position, if in doubt, just stay OUT!!!
 
one other thing, take great care with such a situation.  i have known of some that have turned deadly.  the CO is your best bet to take care of the problem.  mistakes happen, but there are those of us that still respect the rights of landowners and have no problems following the rules of good hunter/landowner etiquette.

Yeah, I truly hope things work themselves out peacefully, but when you're dealing with scum of the earth you just never can tell.

I am the same as you my friend.  I am a NON-landowner as well.  However, (just as you I would imagine) I was brought up to respect property lines and to always ask permission before crossing a fence or a boundary line, whether the land was posted "No Trespassing" or not.  That's the way my Grandfather wanted it done when he was teaching me how to hunt.  He's gone now, but he would have personally kicked my butt if I would have disobeyed his wishes.  Heck, he probably still could find a way to kick my behind to this day!  He was a special individual. 
 
Anyway, I've calmed down quite a bit since this past week, but I am really getting sick of all the lawless behavior these days.  There are so many people out there who just don't care about the law or the rights of the person who owns property, whether it be land, a house, a car or anything else that rightfully belongs to another individual.  It's truly sad and disheartening to think that our world has come to this.

as a landowner, my solution would be very simple.  I would have a new stand to use.  maybe leave a message on the tree with the information that they were trespassing and then leave my number.  then let them know they can go and pick up their treestand at the local police station and explain why they were trespassing in the first place.  with the land owner responsibiltiy laws the way they are, can't afford to be nice to anyone any more.
when out bear hunting, make sure you are at least faster than the slowest person in your party!!!

Pretty standard way to do it around here is just what TLC said. We take the stand, leave a note, and see what happens. We've never had anyone come and claim the stand or go to the local police and report their stand was stolen. It stops and then it starts, it seems to go in cycles

Steve, this might surprise you, but I can be a bit abrasive at times.  I know, I know, its hard to believe, but its true.  may not be the best idea, but would think it would cause it to stop by taking the stand.  and that one does look like a good one.  now that I've read CWA's post, maybe I was right.  wife says it happens occasionally.  usually when she's not around.......

Several years ago my uncle caught someone hunting turkey on our property.Which is posted and clearly visable.He kicked him off and as I was heading back to the cabin I bumped into this person who proceeded to tell me some fat guy just kick him off.He was a little surprise when I told him it was my uncle and whats he still do on the property.He left pretty fast.

Yea, take the stand and tell them to collect it at the Game wardens station.
 
However if this guy shot in the air in the general direction of Frank, be careful doing so.
 
I would be armed when I did so.
 
I would guess he is someone from around there to start with.

I can honestly say i would of been mad!!! I can also say that i have no patience for trespassers or guys who drive up & down the road & take shots at deer on my property. I sure keep a close eye on my property & lease property. Hope you catch them Steve!!

Sorry I'm late,... just noticed this thread.

Being a property owner,.. and having to deal with these kinds of situations myself here's  what you need to do.

1st,.. if either of you have a trail camera put one up in an obscure location but close enough that you can capture the faces of the trespassers. Leave it up for a
couple of weeks and check it afterwords for any pictures.

2nd,.. climb up to the stand and see if they have any names, addresses, ID numbers attached or etched into it. (our Michigan Law requires it for public lands)

After your 2 week wait take down the stand and steps,.. be sure you record the stand setup with pictures that have a date / time stamped picture.  Also, if you have a GPS,.. a picture of everything to include the GPS's recorded coordinates. This way there's NO dispute as to WHERE the stand was located. After you have taken it down (the land owner can keep it at his location) place a note on the tree informing them that it was placed on private property and they will need to contact the local authorities if they want its return. Remember to leave your trail cam setup and running. You'll want to cherish the faces of the perpetrators on film for both yourself and the authorities.  

You can rest assured your going to have some good entertaining pictures when they see that their stand is no longer where they put it. The LEO's love this kind of documentation,.. it makes their job SO much easier when it comes time to arrest or punish the bad guys. According to our laws here in Michigan, any stands or blinds placed on private property without the direct consent of the property owner,... is forfeited to the land owner,.. no arguments are accepted.

Oh,.. an' by the way, that IS a nice stand ! I've never seen one quite like it before and it's got to be at least a 3 man setup to install that thing unless they had a pulley setup in the tree to help them with it.  At least from the way the picture looks.

Good Luck with catchin' these people!! I hate poachers & trespassers!!

Steve,... I wanted to share with you (along with everyone else here) a little item I engineered for protecting my Stealth Trail cam from theft and damage.

The main concern I had when I put my cam up to snap a few pictures of them trespassing  was them finding the camera and either stealing it, or trying to damage it and this little idea works perfectly and won't break the bank to manufacture at home.

It consists basically of an old Army surplus 30-06 ammo can,.. I had to cut a couple of openings in it for the optics to be able to function and so there'd be a way to lock it shut. I'm going to post some pictures of it with descriptions along the way of my explanations of it. First you need to purchase an old ammo can,.. they are readily available and will cost you about $10 or so. I think when I got mine it was $6 but I'm adding in the inflation factor.

Once you get the ammo can take your trail-cam and lay it along side the ammo can to determine where you need to cut holes on the side to allow the optics and flash to function.



Once you have done that your going to need to cut a circular hole in the flip-up latch that closes the the lid of the ammo can and secures it.



You'll need to go up to your local hardware store to purchase a threaded U-Bolt and drill out 2 holes to accommodate the diameter of the U-Bolt shank and securely tighten it down from the inside of the ammo can.

The next thing you'll need to do is to get your self some 4-6 inch LAG bolts with large flat washers and drill out 2 holes in the other side of the ammo can that will fit the diameter of the lag bolts.



Now that this has been completed all thats left is to insert your camera into the box to see how well it will fit your openings. Depending on how thick your unit is you might have to shim it up a bit to take out any loose play. I did mine with some scrap foam material.



Your finished product should look something like this picture below,... make  sure there is sufficient padding around the camera so it won't alter its position. That way the camera can't move when it's taking the picture and your pictures will be clear.



Then all that's left for you to do is take it out to a tree of your choosing and run those LAG bolts with the flat washers through the can and into the tree from the inside of the ammo can, slide in your camera and padding, close the handle and latch it securely and run a padlock though the U-Bolt.

Your all done!

Now I went the extra mile on mine and glued down some camo material to help it blend in better but it's not necessary to do that unless you want to. The cans are normally already OD Green to begin with. We were having a problem in the neighborhood here with cameras coming up missing from time to time,... this was my cure to the problem.

There's no way in hell  ANYONE'S going to be yanking that ammo can off the tree once you tighten it down to it !  

The only other alternative I had at the time was the manufactures little cloth belt thing you used to tighten the camera to a tree with,... that wasn't going to cut it.

Oh yeah,... forgot one item,.. try to mount it up higher than the normal pesons height would be. Bring a small folding step ladder and put it up about 8-10 foot off of the ground. and if you think it won't be pointing down enough a 45* wedge cut from a 2x4 placed behind the lockbox before tightening it down to the tree wi

Mike,.. I used a metal hole saw with a drill for the lock hole in the latch mechanism. For the larger hole you can either use a cut-off wheel or if you have access to one,.. a Plasma cutter. As far as shooting it, or cutting the tree down I guess those are possibilities. But if they are coming onto private land out of season with a weapon or chainsaw, and its documented with the camera they just dug their hole a little deeper. Normally when someone is already doing something wrong and they know it they try to remain as "low-profile" as possible.
Lugging a rifle or chainsaw into the woods especially on their initial stand investigation I don't think would happen. Besides,... after the stand has been pulled down and they find the note they normally won't be back. If they were honestly unaware of the fact they were trespassing I'm sure they would contact the authorities about the stand. If you don't ever hear anything from them it's a sign that they'd rather forfeit the stand than face the law regarding the placement of it on private property.
 
If you remember those old WWII ammo cans they are constructed outta' some pretty tough steel and it would take a lot to damage it. Besides that's the whole idea of concealment,.. if they are unaware of it's presence there's no reason to think it would be damaged by them.

I'm with you 100%.  I have a couple of those ammo cans and they are very handy.  I'm not into the trailcam stuff, but thought I would ask the question right away in case someone else wanted to do their thing.  You did a great job on it and concealment is hopefully the number 1 thing to keeping it intact.  Good job and take a look at my comment on the bow hunting thread buddy!
