Sentencing Set In Teen Hunting Death Case

A St. Albans, West Virginia, man is scheduled to be sentenced May 29, after pleading guilty to felony and misdemeanor charges related to the shooting death of 16-year-old Nicholas Lee Caldwell during a turkey-hunting trip.

Andrew Scott Hardin, 20, reportedly told police that he mistook Caldwell, also of St. Albans, for wildlife in the incident that occurred in April of 2008. As part of a plea agreement, Hardin faces up to one year in jail for killing a person while hunting, and failing to render aid, according to the report.


Only one year in jail for killing a kid while hunting turkey's? How can you mistake a hunter for a turkey? Then the guy doesn't try to help the kid? Something about this story just doesn't pass the stink test.

That just makes me sick!!! How the **** do you shoot a human thinking it is "wildlife" ,this guy was either drunk, high, plain stupid or all three. To top it all off then he doesn't even help the por kid. RIDICULOUS!!!! This guy doesn't deserve to walk through the woods let alone a street sidewalk, ONE YEAR?? pathetic.

We had a Judge over in Kalamazoo give a guy one day in jail and three years probation for DUI that killed two people!!!  The Prosecutor is appealing the sentence and everyone will probably try to run that Judge right out of town!!!

How did that happen with a shotgun you got to be close like 50 yards or less, Now I could see it happening with a 06 or something like that were you might not have even seen the guy.

Hate to pass judgement without the facts but based on that post, it doesn't pass the stink test, somethings just not right with that ruling!!!

I can't understand why this guy gets such a light sentence. To shoot someone thinking that they're game is stupid and beyond explanination to begin with but to not lend assistance is beyond the pale. He should have had the book thrown at him.

How anyone can mistake a person for a turkey, bear, deer, caribou, elk, etc., is beyond me.  There should be no excuse whatsoever!  The sentence should be flat-out, 100 percent murder.
 
This sort of thing happens every freakin' year, and the majority of these incidents are during turkey season.  It's just downright mind-boggling how anybody in their right mind could shoot at something that "looks" like a turkey, bear, deer, etc., without knowing EXACTLY what the heck they're shooting at!
 
These incidents are not hunting accidents by any means!  The person pulling that trigger is not a hunter, he is a murderer plain and simple.  To be that negligent and careless should come with a stiff penalty!  I could go on and on, but my blood pressure is starting to rise to unhealthy levels!!
